Qualified Domestic Relations Order (QDROs)
You are an attorney who has worked hard to get your client's divorce settled. The
judgment or decree has been signed by the judge. You're done, right? No, that
pension, 401(k), TSP, or ESOP still needs to be divided. That's where our QDRO
services come in.
If you call Chris before the divorce judgment is signed, he can help you frame the
language in the judgment to carry out the parties' intent. Chris can also help in some
cases to prepare the QDRO language for insertion directly into the divorce decree.
After the judgment is signed, provide Chris with the judgment or decree, a recent
retirement plan statement, and a specific set of vital information about the parties.
He will prepare the Domestic Relations Order to divide the plan balance in the
method the parties agreed to as reflected in the judgment or decree.
In flat fee QDRO preparation, Chris does not take an advocacy role - that's your
job. If there is a bump in the road, an ambiguity, or a dispute, he'll provide you with
the pertinent information on the options, to enable you to negotiate or resolve the
issue with the four other people involved in the QDRO - your client, the other party,
the other attorney, and the plan.
Personal service is our hallmark. Some QDRO drafters rely on form banks and
cut-and-paste to prepare their orders. Others use paralegals and administrative
assistants to do the drafting, while an attorney gives the documents their "blessing"
on the way out the door.
